Everything you need to know

01What Is a Paternity Leave Policy?

A paternity leave policy defines the time off available to fathers and non-birthing parents to bond with and care for a new child. It sets out leave length, pay, eligibility, and how the leave fits alongside other parental or family leave. A clear policy helps new parents plan their time at home and ensures the company treats caregiving fairly regardless of gender or family structure.

02Why Companies Need a Paternity Leave Policy

Offering paternity leave supports equity, encourages shared caregiving, and strengthens recruiting and retention among younger workers. It also reduces the risk of discrimination claims that arise when only birthing parents receive meaningful leave. A documented policy sets consistent expectations around notice, pay, and duration, and it signals a modern, family-friendly culture that helps the organization compete for talent.

03What a Paternity Leave Policy Should Include

Define eligibility, leave duration, and whether the time is paid, unpaid, or a mix. Clarify that the policy covers fathers, partners, and adoptive or foster parents, and explain how it aligns with any gender-neutral parental leave. Cover notice requirements, how leave can be split or taken continuously, and benefit continuation. Include job-protection terms and how the leave interacts with FMLA or local family-leave entitlements.
