Everything you need to know

01What Is a Shops & Establishments Act Compliance Policy?

This policy sets out how an Indian business complies with the state Shops and Establishments Act that governs its premises. These state-specific laws regulate working hours, weekly offs, leave, overtime, and employment conditions for commercial establishments. The policy documents registration, record-keeping, and working-condition obligations so the company meets its legal duties consistently across every registered location it operates.

02Why Companies Need This Compliance Policy

The Shops and Establishments Act applies to most offices, shops, and commercial premises in India, and non-compliance invites penalties, notices, and reputational risk. Because each state has its own version, businesses operating in multiple states face varied rules. A documented policy ensures registration is current, statutory registers are maintained, and working-hour and leave rules are followed uniformly, reducing audit and inspection exposure.

03What This Compliance Policy Should Include

Cover registration and renewal timelines for each establishment, and the state Acts that apply. Define working hours, spread-over limits, weekly holidays, overtime rules, and leave entitlements per applicable state law. Specify statutory registers and records to maintain, display requirements for certificates, and rules on opening and closing hours. Assign responsibility for filings and inspections, and note penalties for non-compliance.
