Contract Labor Policy India Company Name: Effective Date: Policy Owner: Approved By: Threshold Employee Count: PURPOSE & SCOPE - This policy governs the engagement, management, and statutory compliance obligations related to contract labor employed through licensed contractors at the Organization's establishments in India, in accordance with the Contract Labor (Regulation and Abolition) Act, 1970. - The Organization shall obtain and maintain a valid registration certificate as a principal employer under the Contract Labor Act for every establishment where 20 or more contract workers are employed on any day in the preceding 12 months. CONTRACTOR SELECTION & LICENSING - The Organization shall engage only licensed contractors who hold a valid licence under the Contract Labor Act. Before awarding any contract, the Organization shall verify the contractor's licence, compliance history, financial stability, and capacity to meet statutory welfare obligations. - All contracts with labor contractors shall be documented in a written agreement that specifies the scope of work, the number of workers, the duration, the wage and benefit obligations, the compliance responsibilities of each party, and the conditions for contract termination. WELFARE OBLIGATIONS & WORKING CONDITIONS - The Organization, as principal employer, shall ensure that contract workers are provided with adequate canteen facilities, rest rooms, drinking water, latrines, urinals, first-aid facilities, and any other welfare amenities prescribed by the Act and applicable rules. - Contract workers shall be paid wages not less than the applicable minimum wages on or before the due date. The Organization shall ensure that the contractor makes timely payment, and shall directly pay the workers and recover the amount from the contractor if the contractor defaults. COMPLIANCE MONITORING & RECORD KEEPING - The Organization shall monitor contractor compliance on an ongoing basis through monthly verification of wage records, statutory contribution challans, licence validity, and welfare facility maintenance. Non-compliant contractors shall be issued corrective action notices. - The Organization shall maintain all registers and records required of a principal employer under the Contract Labor Act, including the register of contractors, the register of contract workers, wage records, and attendance records, and shall make them available for inspection. - The Organization shall not engage contract labor for any work that has been prohibited by an appropriate government notification under Section 10 of the Contract Labor Act. Any notification abolishing contract labor in a specific process or operation shall be complied with immediately. POLICY GOVERNANCE & REVIEW - This policy shall be reviewed at least annually and whenever there is a material change in the Contract Labor Act, the applicable state rules, or the Organization's use of contract labor. The HR and Legal teams shall jointly ensure compliance across all establishments.
