PURPOSE & SCOPE
- This policy establishes the Organization's commitment to providing reasonable accommodations to qualified individuals with disabilities in compliance with the Americans with Disabilities Act of 1990 (ADA), as amended by the ADA Amendments Act of 2008.
- This policy applies to all aspects of the employment relationship, including recruitment, hiring, training, promotion, compensation, benefits, discipline, and separation, for all employees and applicants for employment.
- The Organization's designated ADA Coordinator shall oversee the implementation of this policy, serve as the primary point of contact for accommodation requests, and ensure that the interactive process is conducted in a timely and compliant manner.

KEY DEFINITIONS
- Under the ADA, a disability is a physical or mental impairment that substantially limits one or more major life activities, a record of such an impairment, or being regarded as having such an impairment. The ADAAA broadened the definition to ensure maximum coverage.
- A qualified individual is a person with a disability who can perform the essential functions of the position held or desired, with or without reasonable accommodation. Essential functions are the fundamental duties of the position, not the marginal or incidental tasks.
- A reasonable accommodation is any modification or adjustment to a job, the work environment, or the way things are usually done that enables a qualified individual with a disability to perform the essential functions of the position or enjoy equal employment opportunities.

THE INTERACTIVE PROCESS
- When an employee or applicant requests an accommodation, or when the Organization becomes aware that an accommodation may be needed, the ADA Coordinator shall initiate a good-faith interactive process to identify the individual's limitations and potential effective accommodations.
- The Organization may request medical documentation from the individual's healthcare provider to verify the existence of a disability and the functional limitations that necessitate accommodation, but only when the disability or need for accommodation is not obvious.
- The ADA Coordinator shall document each step of the interactive process, including the initial request, the information gathered, the accommodations considered, and the rationale for the accommodation selected or, where applicable, the reason an accommodation could not be provided.

UNDUE HARDSHIP & ACCOMMODATION DECISIONS
- The Organization is not required to provide an accommodation that would impose an undue hardship, defined as an action requiring significant difficulty or expense when considered in light of the Organization's size, financial resources, and the nature and structure of its operations.
- The Organization shall communicate the outcome of the accommodation evaluation to the individual in writing within 15 business days of completing the interactive process, including the accommodation to be provided or the reason the request cannot be granted.
- Accommodations shall be implemented promptly upon approval and shall be reviewed periodically to assess their continued effectiveness. The individual and their manager may request a reassessment at any time if circumstances change.

COMPLAINT PROCEDURE, RETALIATION PROTECTION & POLICY REVIEW
- Any individual who believes they have been denied a reasonable accommodation or subjected to disability discrimination may file a complaint with the ADA Coordinator, the HR department, or through the Organization's confidential reporting mechanism. Complaints shall be investigated promptly and thoroughly.
- The Organization strictly prohibits retaliation against any individual who requests an accommodation, participates in the interactive process, files a disability discrimination complaint, or exercises any right under the ADA. Retaliation shall be treated as an independent and serious violation of this policy.
- This policy shall be reviewed at least annually by the policy owner in consultation with Legal Counsel and the ADA Coordinator to ensure continued compliance with the ADA, the ADAAA, EEOC guidance, and applicable state and local disability discrimination laws.
